Digital nomad visa lawyers in Spain

If you work remotely for an employer or clients outside Spain, the digital nomad visa lets you live here legally and keep that work. We check that you qualify, build a file the authorities can approve without questions and stay with you until you hold your residence card, with your partner and children included.

We are a Spanish law firm based in Seville and we file applications for clients anywhere in Spain. One immigration solicitor leads your case from the first call, in English, with a fixed quote in writing before we start.

Quick answers

What clients ask before anything else

Figures for 2026, checked against the Spanish Official Gazette (BOE) and the guidance of the Large Companies and Strategic Groups Unit (UGE), the government office that decides these applications in Spain.

How much do I need to earn?
€34,188 a year before tax, which is 200% of Spain’s 2026 minimum wage. More is needed for each family member who moves with you.
Can I apply from Spain?
Yes, if you are here legally, for example as a visitor within your 90 days. The UGE must decide within 20 days, and if it does not answer, the application is approved.
How long is it valid?
A consular visa is valid for up to one year. A permit granted in Spain lasts up to three years and is renewed for two years at a time.
Can I work for Spanish clients?
Employees can only work for their foreign employer. Self-employed professionals can bill Spanish clients for up to 20% of their total work.
Will I pay tax in Spain?
Usually yes, once you spend more than 183 days a year here. Remote employees can often opt for a flat 24% on employment income up to €600,000.
What does a consultation cost?
€150, VAT included, deducted from our fees if you instruct us. You leave knowing whether you qualify and what your file needs.

Requirements 2026

What the law asks of you and your employer

The permit is regulated by articles 74 bis to 74 quinquies of Law 14/2013, added by the 2022 Startups Law. These are the conditions the authorities check in every file.

RequirementWhat it means in practice
Remote work for a foreign companyYour work must be done remotely, using computers and telecommunications, for a company or clients based outside Spain.
Income€34,188 a year for the applicant in 2026 (200% of the minimum wage of €1,221 paid 14 times). Add €12,821 a year for the first family member and €4,274 a year for each additional one. Consulates sometimes express these amounts as monthly figures, so we check the method yours uses.
Qualifications or experienceA university degree or postgraduate qualification, or at least three years of professional experience in the work you will do.
Your employer or clientsThe company or group must have been operating for at least one year.
Length of the relationshipAt least three months working with that employer or those clients before you apply, with written permission to work remotely from Spain.
Spanish clientsEmployees work only for the foreign employer. Self-employed professionals may bill Spanish clients up to 20% of their total activity.
Criminal recordNo criminal record in Spain or in the countries where you have lived in the last two years, plus a sworn statement covering the last five.
Health coverSpanish public cover or private health insurance from an insurer authorised in Spain, with no copayments and no waiting periods. Travel insurance is not accepted.
Legal stayIf you apply from Spain, you must be here legally when you file.
Who qualifies

Designed for people whose office is a laptop

The permit suits employees of foreign companies who already work from home, and freelancers and consultants whose clients are mostly abroad: software developers, designers, marketing and finance professionals, writers, translators and similar roles. It is open to nationals of countries outside the EU, including British, American, Canadian and Australian citizens.

Who it is not for

Jobs that need you on site, people whose main clients are in Spain, and employees of a Spanish branch of their company, who usually need a different permit. If you already live here on a non-lucrative permit, remote work you have done on it cannot support this application.

Our viewMost problems we see have three causes: an employment contract that says nothing about working from Spain, company documents from abroad without legalisation or a sworn translation, and income that cannot be traced to the remote work. We build your file around those three points before anything is filed.
Two ways to apply

From a consulate or from Spain

You can apply for a visa at the Spanish consulate that covers the place where you legally live, or apply for the residence permit once you are in Spain. The right choice depends on your timing, your family and where you are now.

Visa from a consulatePermit from Spain (UGE)
Where you applyThe Spanish consulate for your place of legal residenceOnline, to the UGE, while you are legally in Spain
Decision time10 working days once the file is complete20 days; if there is no answer, it is approved
ValidityUp to one yearUp to three years
AfterwardsApply to the UGE for residence in the 60 days before the visa expiresRenew for two years at a time
Best forPeople who want everything settled before they movePeople already in Spain as visitors who meet every requirement

After five years of continuous legal residence you can apply for long-term residence, and later for Spanish nationality, which as a rule requires ten years of residence (two for nationals of Ibero-American countries).

Family

Your partner and children can come with you

Who can join you
Your spouse or registered partner, your children under 18 or adult children who depend on you, and parents who depend on you.
When they apply
At the same time as you, which is usually simpler, or later once your permit has been granted.
Can they work?
Yes. Family members on this permit can work in Spain, as employees or self-employed, without any further authorisation.
Tax and social security

Plan both before you move

Tax residence
Spending more than 183 days in Spain in a calendar year makes you a Spanish tax resident, taxed on your worldwide income. Your tax position should be planned before you arrive, not after.
The special regime for employees
Remote employees on this permit can usually opt for the special regime known as the Beckham Law: 24% on employment income up to €600,000 and 47% above, for the year you arrive and the following five. You must not have been tax resident in Spain in the previous five years, and you opt in with form 149 within six months of starting work here.
If you are self-employed
The special regime is written for employees. Freelancers are normally taxed under the general rules, so we look at your numbers with a tax adviser before you decide.
Social security
The general rule is registration with Spanish social security. Employees from a country with a social security agreement with Spain, such as the United Kingdom, can keep their home cover with a certificate. Self-employed applicants register in Spain.
Do not skip it
Failing to register with social security when you should can lead to the permit being withdrawn. We check which option applies to you before you file.
Your home and your company
Buying a home, keeping a company abroad or renting out your old house all affect your tax position. The same firm can advise on the property side.
Documents

What your file usually contains

  • Full passport.
  • Your employment contract or client contracts, with written permission to work remotely from Spain.
  • A company certificate showing at least one year of activity.
  • Proof of at least three months working with that employer or those clients.
  • Your degree, or proof of three years of professional experience.
  • Proof of income: payslips, invoices and bank statements.
  • Criminal record certificates and a sworn statement.
  • Health insurance or proof of social security cover.
  • For family members: marriage or birth certificates and proof of dependency.

British and American applicants

British applicants usually provide an ACRO police certificate, and an S1 form can serve as health cover. American applicants usually need an FBI background check with an apostille, and consulates such as Houston accept it only if it was issued in the last six months. Each consulate publishes its own list and only takes residents of its district, so we prepare your file against the list of your consulate.

Translations and apostillesDocuments issued abroad generally need an apostille or legalisation and a sworn translation into Spanish. We tell you which ones, so you only pay for what is needed.
Why files fail

The problems we prevent

Remote work not documented
A contract or letter that does not say you may work from Spain is one of the most common reasons for a request for more documents.
Income that does not add up
Payments that cannot be traced to the remote work, or income just under the threshold once family members are counted.
The wrong insurance
Travel policies, reimbursement-only policies or policies with copayments are rejected.
A company too new
An employer or a client company with less than one year of activity does not meet the requirement.
Too many Spanish clients
Freelancers who bill more than 20% of their work to Spanish clients fall outside this permit.
Documents out of date
Certificates expire. We plan the order in which you request them so they are all valid on the day you file.

If your application has already been refused, you can usually file an administrative appeal within one month or go to court within two months. Sometimes a new, stronger application is faster. We review the reasons and tell you which option makes sense.
