Where you can divorce, and which law applies
If you both live on the Costa del Sol, the Spanish courts can usually hear your divorce under the EU rules, which look at where the spouses live. Where you file first can change the rules on money, so get advice before you file or reply.
British couples: since 1 January 2021 the EU rules no longer apply between Spain and the UK. Both countries can have jurisdiction, and their financial rules are very different.
Agreed or contested
Before a notary
You agree on everything and have no minor children. The agreement is signed in a public deed, with a lawyer.
Agreed, in court
You agree and have minor children. The judge approves the agreement you both sign.
Contested
There is no agreement. We represent you in court on custody, maintenance, the home and your assets.
What happens to the children and the house
Custody, contact and maintenance are decided in the children’s interest. If one parent wants to move abroad with the children, the other parent’s consent or a court decision is needed.
Without an agreement, the children and the parent they live with usually keep the use of the family home. Ownership depends on your property regime, which for international couples depends on dates, nationalities and where you first lived as a couple.
