In 30 seconds
- On 7 October 2026 Spain published two Royal Decree-laws that change residential lettings: 29/2026 applies from 8 October and 28/2026 from 15 November 2026.
- They affect seasonal lets, rent reviews, the length of long-term leases (tenancy agreements for a main home) and what a landlord owes a tenant on non-renewal.
- Both still need validation by the Standing Committee of Congress. If they are not validated, they will be revoked.

What changes
The six changes, in plain English
Each change in one sentence. Open “Read the detail” for the exact conditions and exceptions.
Seasonal lets need a real, provable reason
From 8 October 2026. A short let only counts as temporary if the tenant is away from their usual home for a reason you can prove, such as a work posting, studies or medical treatment. Otherwise it is treated as a long-term home lease.
Read the detail
Until now, calling a contract a seasonal let (arrendamiento de temporada) took it outside the protective rules for homes. From 8 October the law instead recognises a temporary housing lease: one for a tenant temporarily away from their usual home for a justified reason that can be proved. The contract must state the reason, and in a dispute the landlord must prove it was real. The term must exceed 31 days and, as a rule, not exceed 12 months.
Without a valid reason, the contract is a habitual-residence lease from signature: at least five years (seven for company landlords). The same applies if the let exceeds 12 months without justification, or if more than two consecutive temporary contracts are signed between the same parties for the same property. Room lets are now housing leases, and the rooms together cannot be let for more than the whole property.
The decree does not list valid reasons, so a long leisure stay, such as a winter let to someone who keeps a home abroad, is not clearly covered. Record the tenant’s permanent address, the reason and the end date, with evidence.
Tourist lets (holiday lets) stay outside tenancy law only if they comply with regional tourism rules and each stay is 31 days or less. From 1 December 2026, furnished lets of 30 nights or fewer pay 10% VAT unless the owner lives in the property. Holiday-home owners should check the VAT position with their tax adviser; our property lawyers for Marbella can review the contracts.
Seasonal contracts signed before 8 October keep the old rules until their agreed end date and then expire without extension. A renewal is subject to the new rules.
Rent reviews capped at 2% until the end of 2027
Reviews from 8 October 2026 to 31 December 2027. Without a new agreement between landlord and tenant, the annual increase cannot exceed 2%. If the rent is already above the official reference index, there is no increase at all.

For housing leases with an annual review between 8 October 2026 and 31 December 2027, the increase is whatever the parties newly agree. Without a new agreement it cannot exceed 2%. If the rent already exceeds the official reference index, there is no increase.
A lease with no review clause has no annual increase, and a review can never exceed the official IRAV index.
Tenants can ask for up to two extra years
Leases ending before 2029. A tenant who is up to date with the rent can request an extension of up to two years, in annual periods and on the same terms. In most cases the landlord must accept.
Read the detail
A tenant whose habitual-residence lease was in force on 8 October 2026 can request an extension of up to two years, in annual periods and on the same terms, if the minimum five or seven years ends before 31 December 2028, or if its tacit extension comes to an end. The tenant must be up to date and have paid on time in each of the previous eight months.
The landlord must accept, unless the parties agree other terms or a new contract, the landlord has validly given notice that they need the home for themselves or close family, or they agree a rent at least 5% lower. In declared stressed areas, the three-year extension applies instead.
Five-year renewals and compensation for non-renewal
From 15 November 2026. Long-term leases renew automatically for five more years (seven with company landlords). A landlord who does not renew must, as a rule, compensate the tenant.
Read the detail
Under Royal Decree-law 28/2026, once a habitual-residence lease has lasted five years (seven for company landlords), it renews automatically for further periods of the same length unless a party gives notice: six months for the landlord, two for the tenant.
A landlord who does not renew must pay the higher of 12 monthly payments or one monthly payment per year the tenant has lived there. The monthly figure is the top of the range in the State rental price reference system for that property, or the current rent if the system gives no value. It is paid on return of the keys; a buyer of the property inherits the obligation.
No compensation is due if the notice states, in detail, that:
- the landlord, an individual, needs the home for themselves, close relatives or a former spouse (if nobody moves in within three months, compensation becomes payable);
- the tenant has been absent more than six of the last 12 months without good reason;
- the tenant has another suitable home in the same municipality;
- the parties sign a new habitual-residence lease;
- or the tenant refuses a formal offer of a new five-year lease (seven for companies) at a rent within the stressed-area limits.
If the tenant could request a mandatory extension and does not, no compensation is due; if they request it, compensation is paid when it ends.
For leases already running, the new regime applies to expiry dates after 15 November 2026. Non-renewal notices validly served before publication on 7 October keep their effect without compensation. If fewer than six months remain on 15 November, four months’ notice is enough. Leases in an annual tacit extension finish it under the old rules first.
Limits on guarantees, costs and fees
Contracts signed from 8 October 2026. Extra guarantees are capped and the tenant can no longer be charged the property tax, letting agency fees or renewal fees.
Read the detail
As a general rule these apply to contracts signed from 8 October 2026; earlier leases keep the law in force when they were signed, save where the decree says otherwise.
Additional guarantees are capped at two months’ rent (one for temporary lets), and rent default insurance cannot be required of the tenant. IBI and other property taxes, letting agency fees and renewal fees cannot be passed on to the tenant.
The tenant’s right of first refusal on a sale can no longer be waived.
Repairs and the check-out record
Contracts signed from 8 October 2026. Landlords have 15 days to answer a written repair request. Both parties must sign a check-out record when the keys are returned.
Read the detail
If a defect affects habitability, the landlord has 15 calendar days to answer a written request with a quote; otherwise the tenant may repair and deduct the cost from the rent (five working days in temporary lets).
Both parties must sign a check-out record, similar to a check-out inventory in the UK. Without one, the property is presumed returned in good condition.
Worked examples
What it means in euros
Rent review with no new agreement
€1,500 → €1,530A rent of €1,500 a month can rise to €1,530 at most (2%).
Compensation for non-renewal
€14,400With a reference value of €1,200 and six years of residence, the compensation is 12 × €1,200, because 12 monthly payments is more than six.
For landlords
What landlords should do now
- Check that each seasonal contract states a reason you can prove.
- Update your tenancy agreement template on insurance, taxes, fees and guarantees.
- Apply the 2% limit at each review unless you reach a new agreement.
- Before serving notice on a lease expiring after 15 November, calculate the compensation and check the exceptions.
- If you live abroad, give the tenant a reliable address for notices or appoint a representative in Spain.
- The new landlord tax reductions belong to Spanish personal income tax (IRPF); non-resident owners should ask their tax adviser whether any applies to them.
For tenants
If you are a tenant
- If your lease ends before 2029 and you are up to date, request the two-year extension in writing, with proof of delivery.
- If you asked on 1 or 2 October under the revoked decree, ask again: the new decree confirms only requests made under Royal Decree-law 8/2026.
- If you hold a seasonal contract with no real reason for the stay, take advice: it may be a habitual-residence lease.
Background
How we got here and what is uncertain
How we got here
Royal Decree-laws 26/2026 and 27/2026, approved on 29 September, were the first version. RDL 26/2026 applied from 1 October. A Royal Decree-law takes effect at once but needs validation within 30 days. On 2 October Congress refused to validate both, so they were revoked and the previous law applied again.
On 5 October the Government dissolved Parliament and called a general election for 29 November (Royal Decree 806/2026). On 6 October it approved the replacement decrees, which keep most of the earlier content with some changes. With the Cortes dissolved, the validation vote falls to the Standing Committee of Congress (Diputación Permanente).
What remains uncertain
If the Standing Committee does not validate the decrees within 30 days of their enactment, they will be revoked, as happened on 2 October. Regional rules on temporary and room lets prevail where they exist, and rent caps on new contracts apply only in declared stressed areas. We will update our full guide in Spanish after the vote.

Questions
Frequently asked questions
When do Spain’s new rental rules apply?
Royal Decree-law 29/2026 has applied since 8 October 2026, although 10% VAT on short lets starts on 1 December 2026. Royal Decree-law 28/2026 applies from 15 November 2026. Both still need validation by the Standing Committee of Congress.
Can I still let my property on a seasonal contract?
Yes, if the contract states a real, provable reason for the tenant’s temporary stay, such as a work posting or studies, and lasts more than 31 days and, as a rule, no more than 12 months. Otherwise it is treated as a habitual-residence lease.
How much can the rent go up until the end of 2027?
For reviews between 8 October 2026 and 31 December 2027, no more than 2% without a new agreement, and nothing if the rent already exceeds the official reference index or the lease has no review clause.
Must a landlord compensate the tenant for not renewing?
From 15 November 2026, generally yes, once the lease has lasted five years (seven for companies): the higher of 12 monthly payments or one per year of residence. Listed exceptions apply, and notices served before 7 October 2026 give no right to compensation.
Do the new rules affect holiday lets?
Tourist lets that follow regional tourism rules stay outside tenancy law only for stays of 31 days or less. From 1 December 2026, furnished lets of 30 nights or fewer pay 10% VAT unless the owner lives in the property.
What happens if the decrees are not validated?
They would be revoked, as Royal Decree-laws 26/2026 and 27/2026 were on 2 October 2026, and the previous rules would apply again.
